Terms of Service

1. Acceptance of Terms

By accessing or using BuilderIQ Analytics (“the Service”), operated by Kwabena Kesse, CPA, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BuilderIQ Analytics is a construction finance intelligence platform that provides WIP schedule management, job cost tracking, covenant monitoring, AI-powered document analysis, competitor intelligence, heat productivity modeling, prevailing wage compliance tracking, and related financial analytics tools.

3. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity under your account

4. Subscription and Payment

The Service is offered on a subscription basis. By selecting a plan, you agree to pay the applicable fees. Payments are processed through Stripe.

• Subscriptions renew automatically unless cancelled
• You may cancel your subscription at any time through the billing portal
• Refunds are handled on a case-by-case basis; contact support@builderiqai.com
• We reserve the right to change pricing with 30 days' written notice

5. Your Data

You retain full ownership of all financial data, documents, and content you upload to BuilderIQ. We do not claim ownership of your data.

You grant us a limited license to process, store, and analyze your data solely to provide the Service. This includes sending data to third-party AI providers (Anthropic) for document analysis when you explicitly request it.

You are responsible for ensuring you have the right to upload any documents or data to the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other users' data
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to store or transmit malicious code
• Exceed reasonable API usage limits or attempt to overload the system
• Resell or redistribute the Service without written permission

7. AI-Generated Content Disclaimer

BuilderIQ uses artificial intelligence to analyze documents, generate financial insights, and provide recommendations. AI-generated content is provided for informational purposes only and should not be considered professional accounting, legal, or financial advice. You are responsible for reviewing and verifying all AI-generated outputs before making business decisions.

8. Financial Data Disclaimer

BuilderIQ is a financial analytics and reporting tool. It does not constitute accounting services, tax advice, or audit services. The calculations, metrics, and alerts provided by the Service are based on data you input and should be verified by a qualified professional before being used for official filings, lender reports, or regulatory compliance.

9. Availability and Support

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDERIQ ANALYTICS AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BuilderIQ Analytics and Kwabena Kesse, CPA from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination:

• Your right to use the Service ceases immediately
• You may request an export of your data within 30 days
• After 30 days, your data will be permanently deleted

13. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Clark County, Nevada.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
